THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10225 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.2 seeking bail in the event of her arrest in connection with Crime.No.197 of 2023 on the file of Nawabpet Police Station, Mahabubnagar, registered for the offence under Section 306 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

On 10.08.2023, a complaint was lodged by the husband of the deceased alleging that in relation to purchase of a plot, there was a dispute in between A-1 and the de-facto complainant's wife. It is alleged that A-1 had given some amount for purchasing the said plot and failed to give remaining amount. It is alleged that A-1 and this petitioner had thrown stones at the house of the deceased and the wife of the deceased picked up a quarrel with them. On 10.08.2023, A-1 and this petitioner abused the deceased saying that her life is waste and asked her to go and die. Thereafter, the deceased committed suicide by jumping into the

well. Though her husband immediately jumped into the well, he failed to rescue her.

An omnibus allegation is made that A-1 and this petitioner allegedly abused the deceased. It is a solitary instance, when the altercation had taken place in respect of sale of property. 5.

In the said circumstances, petitioner who is a lady can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Nawabpet Police Station, Mahbubnagar, on or before 30.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.2 shall appear before the concerned Station House Officer, for the purpose of investigation, as and when required.

3) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
