THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION NO.21080 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to direct the respondents to pay the undisputed measured and quantified bill amount pursuant to the agreements entered into between the petitioner and the 6th respondent with respect to the agreement Nos.(i) agreement No.2013-14, dated 06-02-2014 for execution of the work providing internal roads at Ryali (village) of Atreyapuram Mandal for an estimated cost of Rs.5.00 lakhs, (ii) agreement No.2013-14, dated 10-02-2014 for execution of the work to provide internal roads at Vaddiparru village of Atreyapuram Mandal for an estimated cost of Rs.5.00 lakhs, (iii) agreement No.2013-14, dated 07-02-2014 for execution of the work for construction of Community Hall at S.C. area in Narkedmilli village, Atreyapuram Mandal for an estimated cost of Rs.5.00 lakhs...."

2. Heard Mr.G.Rama Gopal, learned counsel appearing for the petitioner and learned Government Pleader for Finance and Planning appearing for the respondents.

3. Perused the material on record, placed before this Court.

4. The petitioner is a contractor, who executed the works under the supervision of the respondents herein. When the matter is called today, learned Government Pleader appearing for the respondents placed on record a letter in Rc.No.A3/courtcases/2014, dated 30-07-2015, addressed by the Executive Engineer, P.R.I. Division, Rajahmundry to the office of the Government Pleader, High Court of Hyderabad, Hyderabad,. The said letter to the extent of its relevancy to the present case, reads as follows:

"The petitioner was completed for the following works and the following bills was submitted by Dy. Executive Engineer, PRI Sub-Division, Kothapeta for 1st, 2nd & 3rd Bills on dates 10-07-2014, 18-07-2014 & 15-09-2014 respectively. S.No.

The grant was not released so far. After releasing of the grant from the Chief Planning Officer, East Godavari, the payment will be made to the petitioner."

5. It is evident from the above letter that proposals are pending right now with the 4th respondent. In view of the same, this Court deems it appropriate to dispose of the writ petition with a direction to the respondents to arrange payments to the petitioner by fixing some time.

For the aforesaid reasons, the writ petition is disposed of directing the respondents herein to arrange payments to the petitioner for the works executed by him within a period of 3 months from the date of receipt of a copy of this order.
