THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.17508 of 2004 ORDER :
This writ petition is filed seeking a writ of mandamus declaring the action of the respondents-Corporation in filling up the vacancies on deputation basis as arbitrary and illegal and contrary to the recruitment rules and further declare the appointments made on deputation basis as illegal and arbitrary.

Heard Smt.K.Udaya Sri, learned counsel for the petitioner and A.K.Narasimha Rao, counsel for respondents.

It has been contended by the petitioner that the respondentsCorporation is not filling up the vacancies as per the recruitment rules and that various persons are being brought on deputation basis into the Corporation only to deprive the benefit of the existing employees working in the respondents-Corporation.

This Court, having considered the said submissions, is of the considered view that this Writ Petition can be disposed of directing the respondents to fill up the vacancies strictly in accordance with the recruitment rules and if the respondents want to fill up the vacancies on deputation basis, they must record the reasons as to why they are resorting to bring persons on deputation basis instead of filling up the vacancies as per the recruitment rules.

With the above observations, the Writ Petition is disposed of. No costs.
