This writ petition is filed for a mandamus for declaring the action of the 1st respondent in not receiving the petitioner's application for grant of permission for building construction with regard to his property admeasuring 180 square yards bearing No.17-1-388/2A/B/12, Dhobighat, Saidabad, Hyderabad and thereby insisting on a "No Objection Certificate" from the Revenue authorities/District Collector, Hyderabad as illegal and arbitrary and for a consequential direction to direct the 1st respondent to receive and consider the petitioner's application.
2. When the matter is taken up for hearing, learned counsel for the petitioner represented that the subject matter of the present writ petition is squarely covered by the judgment of this Court in Hyderabad Potteries Private Limited v. Collector, Hyderabad District and another, and that following the ratio laid down in the above judgment, this court earlier disposed of W.P.No.29724 of 2011 on 08-11-2011 and the same is not disputed or denied by the learned standing counsel for the 1st respondent and for the reasons alike in the above said judgment, this writ petition can be disposed of. Accordingly, the writ petition is disposed of directing the 1st respondentGreater Hyderabad Municipal Corporation, Hyderabad to take appropriate decision on the application made by the petitioner seeking permission to construct a building in accordance with the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, and the Building Rules and Regulations made thereunder without insisting on production of "No Objection Certificate" from the Revenue authorities.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
