This writ petition is filed to declare the action of respondents 2 and 3 in not taking action against the 4th respondent and his associates pursuant to the written complaint of the petitioner, dated 03.12.2019, as illegal, arbitrary and violation of Section 154(3) of Cr.P.C. 2.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 03.01.2020, submits that though the complaint, dated 03.12.2019, was sent by registered post to the 2nd respondent, the 2nd respondent forwarded the said complaint to the 3rd respondent, through proper channel. Upon receipt of the complaint, the 3rd respondent made an entry in General Diary, and to verify the veracity of the contents of the complaint, conducted a preliminary enquiry at the fields of the petitioner. The said enquiry revealed that no incident as complained took place on the said date, nor the persons named in the said complaint disturbed the cashew field of the petitioner. Hence, notice, dated 31.12.2019, was issued to the petitioner informing that no action can be taken on his complaint, as its contents have not been established. 4.

Having regard to the said submission made on behalf of the 3rd respondent, this Court is of the view that no orders need be passed in the writ petition. Since a notice has already been issued to the petitioner by the 3rd respondent as to the action taken on the complaint, it is open for

the petitioner to approach appropriate forum to avail remedies, in accordance with law, if the petitioner is aggrieved by such notice. 5.
