HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 25118 of 2017 Order:

This Writ Petition is filed challenging the action of the third respondent in seizing the Tractor bearing No.TS-26-2420 in R.F. Compartment No.1001 on 21.06.2017 and kept before the second respondent.

Learned counsel for the petitioner submits that though the petitioner filed an application before the Judicial Magistrate of First Class Court at Narsampet, the same was returned as not maintainable. Learned Government Pleader submits that the Divisional Forest Officer has got power to release the vehicle subject to his satisfaction. In the circumstances, liberty is given to the petitioner to make appropriate application before the Divisional Forest Officer, Mahabubabad seeking release of the vehicle and on filing such application, the Divisional Forest Officer, Mahabubabad shall pass appropriate orders in accordance with law.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
