HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5674 of 2016 ORDER :

It is the submission of learned counsel for both sides that R.C.No.170 of 2015 was disposed of by the trial Court and the revision petitioner herein, who is respondent to R.C., is chosen to prefer appeal impugning the legality and correctness including by taking one of the grounds covered by the impugned order in the revision. In view of Section 105 C.P.C. enables such a concession is left open.

Accordingly, the revision is disposed of without prejudice to take such a ground in the appeal to consider on own merits. 3.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
