THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10228 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners-accused Nos.2 and 3 in Crime No.420 of 2023 pending on the file of Station House Officer, Choutuppal Police Station, Yadadri Bhuvanagiri District, registered for the offences punishable under Sections 8 (c) read with 20(b) (II) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State.

Perused the record.

The petitioners were arrested on 02.08.2023 of Chotuppal Police being in possession of 4 KG dry Ganja. 4.

On the other hand, learned Additional Public Prosecutor, on instructions, would submit that there are no other cases pending against these petitioners.

Keeping in view, the contraband seized is less than commercial quantity, this Court deems it appropriate to enlarge the petitioner on bail subject to the following conditions:

This Court deems it appropriate to enlarge the petitioners on bail subject to the following conditions: i) The petitioners/Accused Nos.2 and 3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties i.e., one local surety and other from the native place, for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Choutuppal.

ii) The petitioners-accused Nos.2 and 3 shall appear before the concerned Station House Officer on every Monday between 10.30 AM and 01.00 PM, for a period of eight (8) weeks.

iii) T he petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
