Smt. N. Himayani, v. T.S.R.T.C., Rep. By Its Vice Chairman And Managing Director,
THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.10844 of 2016 O R D E R:
This writ petition is filed under Article 226 of the Constitution of India, for the following relief:
"to issue an order, direction or writ more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in re-posting the petitioner as conductor once she was made unfit for the post of conductor though she has given alternative employment in view of the proceedings of the APSRTC, Tarnaka Hospital, dated 17.12.2014, as the same is illegal, arbitrary and unjust and consequently direct the respondents to continue the petitioner as Record Tracer (RT) with that of the 2nd respondent in the pay scale attached to the post of Conductor."
2. According to the petitioner, she was initially appointed as a Conductor in the respondent Corporation in the year 1999 at Falaknuma Depot. Pursuant to an order passed by this Court in W.P.No.19906 of 2014, vide office order dated 20.04.2015, issued by the Office of the Regional Manager, petitioner herein was posted as Record Tracer for a period of one year.
3. The grievance of the petitioner in the present writ petition precisely is that she made a representation on 02.03.2016, requesting the respondents to permit her to work in the said cadre of Record Tracer for a further period of one year. It is the further case of the petitioner that no orders have been passed on the said representation so far and on the other hand, the respondents are contemplating to post the petitioner herein once again as a Conductor. It is eventually requested by the learned counsel for the petitioner to direct the respondents to take appropriate action on the representation dated 02.03.2016 said to have been submitted by the petitioner herein by fixing some time frame. The said request is not opposed by the learned Standing Counsel, and on the other hand, it is submitted that the same would be considered and appropriate orders will be passed in accordance with law.
4. For the aforesaid reasons, writ petition is disposed of, directing the respondents to consider the representation dated 02.03.2016 said to have been filed by the petitioner herein and pass appropriate orders, in accordance with law, within a period of six weeks from the date of receipt of this order. Till then, status quo as on today with regard to the status of the petitioner shall be maintained. As a sequel, the miscellaneous petitions, if any, shall stand disposed of. There shall be no order as to costs.
