THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE No.1203 OF 2017 ORDER:

None appears for the petitioner.

This contempt case is filed alleging non-implementation of the order in W.P.No.4260 of 2017, dated 08.02.2017. The said writ petition was disposed of with the following observations:- "It is an admitted case that the crime is under investigation and the respondent No.5 is investigating the crime. In the process of investigation, the petitioner submitted representations. It is for the Investigating Officers to take the said representations into consideration and take appropriate action in accordance with law. In view of the clear position of law, no direction can be issued to the respondents more particularly to the respondents 5 and 6 to act in a particular manner and it is for the concerned Magistrate to look into the aspect of the investigation. It is needless to observe that the Investigating Officer would follow due process of law during the course of investigation and would take into consideration the information furnished by the petitioner." Since there is no positive direction, it cannot be alleged that the order was violated.

The contempt case is accordingly dismissed.
