HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.8964 of 2010 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the respondent Nos.4 to 7 in calling the petitioner to the police station in connection with the civil dispute, without registration of any case, as illegal and arbitrary, and consequently, direct the respondents 4 to 7 not to harass the petitioner by calling him to the police station and also direct the respondents 9 and 10 not to interfere with the petitioner's possession over his agricultural land.
The case of the petitioner is that he is the owner and possessor of an extent of Acs.4.87 cents of land in Sy.No.412 of Koduru Village in G. Konduru Mandal, Krishna District, and he acquired the said land from his father. The respondents 9 and 10 have purchased an extent of Acs.6.37 and Acs.6.38 cents of land, respectively, in the same survey number. The MRO has issued patta pass books in the name of the respondents 9 and 10 for their respective extents of land. The respondents 9 and 10 are trying to dispossess the petitioner from the land of the petitioner with a view to grab the same and influencing the respondents 4 to 7 to harass the petitioner. The petitioner submitted representations to the authorities concerned, for demarcation of his land. The respondents 4 to 7 are harassing the petitioner by calling him to the police station at the instance of the respondents 9 and 10. Hence, this writ petition.
Heard and perused the material available on record.
The grievance of the petitioner is that the respondents 4 to 7 are calling the petitioner to the police and harassing him and interfering with the civil dispute, at the instance of respondents 9 and 10. Considering the circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order: The respondents 4 to 7 are directed to not to interfere with the affairs of the petitioner and the unofficial respondents, more particularly, in their civil disputes.
However, this order will not preclude the respondents 4 to 7 to enquire into the matter, if any crime is registered against the petitioner.
No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
