HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9780 of 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State before ordering notice to respondent No.2/ complainant.

The remedy of the petitioner is to approach the Magistrate of the trial Court concerned, where the warrant is issued, for recall by appearance.

Having regard to the above, there is nothing to allow the criminal petition, much less, to keep pending, but for, directing the petitioner to appear before the trial Court concerned and file an application under Section 72 Cr.P.C. for the learned Magistrate after hearing recall the warrant and obtain bond as contemplated by Section 88 Cr.P.C. with or without surities for future due appearance.
