THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 20919 of 2016 ORDER:

This writ petition was filed challenging the inaction on the part of respondent No.5 in extending necessary protection to the officials of respondent No.8-Nandipet Gram Panchayat in taking action against the alleged illegal and unauthorized constructions made by respondent Nos.9 and 10.

The petitioner, aged about 72 years, claims to be the owner of Acs.13.12 guntas of land in Survey Nos.685/1, 2, 3 4, 5 and 686/5 of Nandipet Village, Nandipet Mandal, Nizamabad District. When some persons tried to interfere with the said land, she filed O.S.No.25 of 2001 on the file of the I Additional District Judge, Nizamabad and obtained interim orders on 28.05.2003 in I.A.No.1176 of 2003. Again, when some persons tried to make constructions in the said land, she filed O.S.No.3 of 2014 on the file of the Civil Vacation Judge, Nizamabad, wherein the said Court granted interim directions in I.A.No.19 of 2014. When the construction was not stopped, she lodged a complaint before respondent No.7-District Panchayat Officer, Nizamabad District.

When electricity connection was sought to be given to the said unauthorized constructions, she filed W.P.No.4488 of 2016 and this Court restrained the Electricity Department from giving electricity connection. She also submitted a representation to respondent No.6-District Collector, Nizamabad on 13.06.2016. She came to know that respondent No.8 addressed a letter to respondent No.

17.06.2016 with regard to the inaction of the Police in providing protection to them for taking action against the unauthorized constructions violating the status quo orders passed by the competent civil Court.

It is brought to the notice of this Court by the learned counsel for the petitioner that a letter was addressed by respondent No.7 to the Sub-Divisional Police Officer, Armoor on 13.06.2016 seeking police protection. The present writ petition is filed challenging the action of respondent No.5 in not providing protection in spite of the said complaints and representations.

Learned Government Pleader for Home, on the basis of written instructions, submits that the Police are ready to provide protection if a particular date is intimated to them for taking further action by respondent No.8.

In view of the same, liberty is given to respondent No.8 seeking police protection in case they want to take steps for implementation of the civil Court orders or for enforcing the provisions of the Gram Panchayat Act by duly intimating the date. On receipt of the said information, respondent No.5 shall provide necessary protection to the officials of respondent No.8. The writ petition is accordingly disposed of.
