ORDER:
This writ petition is filed for the following substantive relief: "...issue an order, direction or writ more particularly one in the nature of writ of mandamus declaring the action of the respondents in not paying the terminal benefits consequent to his attaining the age of superannuation dated:
30.04.2000 as wholly illegal, arbitrary and unjust and consequently direct the respondents to pay the terminal benefits consequent to his retirement." After arguing the case, Sri G.Ravi Mohan, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to question the order of the respondents holding that he is deemed to have resigned.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made. Giving liberty to the petitioner shall not be understood as this Court condoning the laches, if any, on the part of the petitioner and the respondents shall be entitled to contest the matter on all legally permissible grounds, including laches.
As a sequel to dismissal of the writ petition, WP.MP.Nos.19946/11 & 6949/12 and WV.M.P.No.3044 of 2008 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 09th September, 2015 VGB
