THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11366 of 2025 This Criminal Petition is filed before this Court for grant of pre-arrest bail to the Petitioner who is arrayed as accused in FIR No.166 of 2025 of Medchal Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2) of the BNS. 2.
The brief facts of the case are that, on 18.02.2025, the de-facto complainant lodged a report before the police stating that the complainant is the authorized representative of Bajaj Allianz General Insurance Company Ltd, stating that a matter of grave concern involving fraudulent medical insurance claims perpetrated by Leela Hospital (A Unit of SK Healthcare, Medchal, Hyderabad) in collusion with one policyholder insured under corporate group policies of the Company. The case pertains to Mr. NandipetaShekar with claim number OC24-1002-8403-00347914, insured under Corporate Policy Number OG-24-1908-8403-00000117 issued to Genius Consultants Limited. A claim amounting to Rs.1,94,880/- was submitted under the cashless claim process for treatment of Viral Pneumonia from 09 February 2024 to 15 February
2024 at Leela Hospital. Being cashless claim company had settled the claim for Rs.1,52,156/-. Upon verification, the diagnostic report for an HRCT chest scan was found Suspicious and on inquiry, Tesla Diagnostics confirmed that no such scan was performed, and the report lacked essential details such as a radiologist's signature and reference number. Further, the insured's attendance records revealed he was "on duty" during the claimed hospitalization period, making the hospitalization claim implausible. It is evident that Leela Hospital cheated his company by fraudulent claims and misrepresenting facts, and conspiring with the claimants to defraud the Company. The actions of the claimant, Mr. Nandipeta Shekar further exacerbate the fraud through their active involvement in misrepresentation and deception. These acts have not only caused financial loss to the Company but also compromised the integrity of the insurance process.. Hence, the complainant requested to take necessary action. Basing on the said complaint, the police registered a case for the above said offences.

Heard Sri T. Praveen Sagar, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla,
learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences. It is further submitted that, initially, the investigating officer has served the notice under Section 35(3) of BNSS to the hospital incharge and thereafter, they are frequently calling the petitioner and threatening the petitioner. It is further submitted that the petitioner is not concerned to the alleged offences. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the petitioner herein is not arrayed as accused and they served notice under Section 35(3) of the BNSS and also required information for further investigation. It is further submitted that there is no such threat to the petitioner herein. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the FIR copy shows that there are allegations against the Leela Hospital and they are also involved in the forgery of the documents and also the notice under Section 35(3) of the BNSS was served to the hospital incharge. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner/accused, subject to the following conditions: i.
The petitioner/Accused shall surrender before the Station House Officer, Medchal Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail, on petitioner executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner/Accused shall abide by the other conditions stipulated in
Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.
iii.
The petitioner/Accused shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
