HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION No.3970 OF 2015 ORDER:
Heard learned counsel for the petitioner.
The limited grievance of petitioner in E.P. No.26 of 2005 in RCC No.1 of 2000 in the Court of Principal Junior Civil Judge, Kavali, is that the disposal of E.P. is taking unduly long time. The learned counsel requests the Court to direct the Principal Junior Civil Judge, Kavali, to dispose of E.P. No.26 of 2005 within a period of six weeks from the date of receipt of a copy of this order.
I have taken note of the limited submission of learned counsel for the petitioner and without notice to the respondents, I am satisfied that the C.R.P. can be disposed of.
The Principal Junior Civil Judge, Kavali, is directed to expeditiously dispose of E.P. No.26 of 2005, preferably within a period of eight weeks from the date of receipt a copy of this order. If either D.Hr/J.Dr does not cooperate with the Court for expeditious disposal of the E.P., the executing Court is given liberty to record reasons and proceed ex parte.
The C.R.P. is ordered. No costs.
Miscellaneous petitions pending, if any, in the C.R.P, shall stand closed.
