HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.9195 of 2017 ORDER:

Heard learned counsel for the petitioners/accused Nos.3 & 4 of crime No.634 of 2017 of Kukatpally Police Station, Cyberabad, registered for the offences punishable under Sections 420 & 120-B IPC, against them along with A.1 and A.2 by names G.Ramulu & G.Durgaiah on the report of the Tahsildar, Kukatpally Mandal and perused the grounds urged in the quash petition and the contents of the FIR and also heard learned Public Prosecutor representing the respondents.

In fact on behalf of Durgaiah, who was the petitioner in W.P.No.13252 of 2014, contempt notice was issued to the District Collector, Deputy Commissioner, Kukatpally, GHMC and Commissioner, GHMC, Executive Engineer, Irrigation and Commissioner, HMDA, regarding the alleged encroachment of Maisamma Tank. Even from the material, there is nothing to interdict the investigation as pointed out by the learned Public Prosecutor, but for to say pending investigation, the petitioners shall not be arrested, however it will not prevent the police to secure the presence of the accused for the purpose of the investigation.

Accordingly and in the result, the Criminal Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed.
