This writ petition is filed to declare the action of respondent No.3 in issuing e-Tender auction notice in Letter No.SMSD/ 109/ 2019, dated 10.10.2019 as illegal, arbitrary and violative of principles of natural justice and consequently to direct the respondents to consider the representation of the petitioner dated 13.12.2019.

Heard the learned counsel for the petitioner and the learned Government Pleader for Endowments for the respondents.

It is the case of the petitioner that she was awarded contract for collection of Seshavastrams, Vadi Biyyam and Dry Coconuts for the year from 01.01.2019 to 31.12.2019.

However, since the petitioner's husband met with an accident on 07.10.2019 and as she was not aware of e-Tender, the petitioner could not make application and take part in the e-Tender auction for renewal of the contract for the year 2020. It is the further case of the petitioner that the petitioner has been granted contract for the last four years and there is no default on the part of the petitioner in paying the tender amounts and nonparticipation in the e-Tender is on account of ill-health of the husband of the petitioner. Therefore, the petitioner prays to direct the respondents to extend the benefit of renewing contract in favour of the petitioner even for the year 2020.

Learned Standing Counsel representing the third respondent temple submits that pursuant to the e-Tender auction notice issued on 10.10.2019, the contract has been awarded in favour of the successful bidder who has also paid the bid amounts as per tender conditions.

Having regard to the said submissions made by the learned Standing Counsel that since the tender process has been already finalized and to become operative with effect from 01.01.2020, no orders can be passed by this Court interfering with the tender process at this stage.

Accordingly, the writ petition is dismissed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
