THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.14091 OF 2006 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction, more particularly one in the nature of writ of Certiorari calling for the records pertaining to G.O.Ms.No.19 dated 15.5.2006 issued by the 1st respondent confirming the orders of 2nd and 3rd respondents as illegal, arbitrary, biased unconstitutional and against the principles of natural justice and to set aside the same."

Heard and perused the material available on record.

From a perusal of the order of respondent No.1/revisional authority vide G.O.Ms.No.19, Social Welfare (LTR.1) Department, dated 15.05.2006, it is evident that respondent No.1 had passed the said order only to the extent of land in R.S.No.181/1c admeasuring Ac.0.12 cents even though the petitioners preferred the revision in connection with lands in R.S.No.191/2 admeasuring Ac.5.60 cs and R.S.No.181/1c admeasuring Ac.0.12 cents covered by a building situated in Swarnavarigudem Village of Jeeulimilli Mandal of West Godavari District. In the said order, even though discussions were made by respondent No.1/revisional authority regarding the ownership of the property and the purchase of the property by these petitioners, no specific orders were passed insofar as the land in R.S.No.191/2 is concerned.

Considering the said fact, the order of respondent No.1 vide G.O.Ms.No.19, Social Welfare (LTR.1) Department, dated 15.05.2006, is hereby set aside and respondent No.1/revisional authority is hereby directed to pass appropriate orders afresh after giving an opportunity to the petitioners as well as the respondents concerned, as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
