THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI CONTEMPT CASE No.1784 OF 2019 O R D E R :

When the matter is taken up for hearing, learned Standing counsel appearing for the respondents informed the Court that pursuant to the order passed by this Court in W.P.No.1962 of 2012, dt.18.09.2019, the case of the petitioners was considered and rejected vide speaking orders dated 23.12.2019 and the Contempt Case may be closed.

Learned counsel for the petitioners has also not disputed the same. However, he contends that the rejection orders are passed contrary to the judgment rendered by the Gujarat High Court in Special Civil Application No.15763 of 2013 dated 12.07.2016 and judgment of this Court in W.P.No.15161 of 1991 dated 29.07.2002. This Court, having considered the rival submissions of both the parties, is of the considered view that respondents have considered and rejected the case of the petitioners vide speaking orders dated 23.12.2019 and accordingly complied with the orders passed by this Court.

With the above observations, the Contempt Case is closed. However, the petitioners are given liberty to challenge the rejection orders dated 23.12.2019, if they are so advised. There shall be no order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
