THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10251 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.3 seeking bail in the event of her arrest in connection with Crime.No.551 of 2023 on the file of Mancherial Town Police Station, Ramagundam, registered for the offences under Sections 204-B and 386 r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioner is seeking anticipatory bail in the complaint filed against her and two others. In the complaint, it is alleged that the authorized personnel of IndusInd Bank had taken possession of the vehicle from the relative of this petitioner. While the de-facto complainant was taking the said vehicle, this petitioner and two others have caught hold of the said person and assaulted him. Fearing death, the de-facto complainant fled from the scene.

As seen from the complaint, the vehicle was taken by the said person. Though the presence of the petitioner is mentioned in the complaint, no specific over tacts are attributed to her. 5.

Learned Additional Public Prosecutor opposed the bail application on the ground that other two accused were granted the relief of regular bail.

Keeping in view that there are no over tacts attributed to this petitioner and further the provision under Section 386 of IPC does not attract as far as this petitioner is concerned, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to following conditions:-

1) The petitioner/Accused No.3 is directed to surrender before the Station House Officer, Mancherial Police Station, Ramagundam, on or before 23.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on her executing personal bond for a sum of Rs.20,000/- (Rupees Twenty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.3 shall appear before the concerned Station House Officer, for the purpose of investigation, as and when required.

3) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
