Yerra Anuradha Naidu v. The State Of Andhra Pradesh
HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3085 of 2015 ORDER:
Heard.
The grievance of the petitioner is that in spite of her complaint, dated 07-12-2014, made before the 3rd respondent, no crime is registered and no action is taken against the culprits. Learned Government Pleader has received instructions from the 4th respondent, which state that on the subject matter of dispute, two suits are already pending viz., O.S.No.26 of 2006 filed by one P.Rama Devi, sister of the petitioner herein before the Junior Civil Judge and the same was also subject matter of A.S.No.45 of 2010 before X Additional Sessions Judge, Machilipatnam, and O.S.No.9 of 2014 filed by the petitioner before the Additional Sessions Judge, Machilipatnam, against the 5th respondent. To the extent of complaint made by the petitioner before the 3rd respondent is concerned, it is stated that crime is already registered being Cr.No.218 of 2014 before the 4th respondent Police Station.
The further instructions received by the learned Government Pleader refer to the said A.S.No.45 of 2010 having been dismissed on 25-10-2014 and pendency of M.C.No.41 of 2014 before the Revenue Sub-Divisional Magistrate, Machilipatnam. In addition to that, it appears that a case in Cr.No.36 of 2005 is also pending before Special Mobile Court, Krishna, Machilipatnam and the said court also directed registration of another case in Cr.No.145 of 2014 against the petitioner herein for allegedly producing fake order of this Court. While those proceedings are pending, case in Cr.No.218 of 2014 is registered on the basis of the petitioner's complaint, dated 07-12-2014 and it is under investigation.
In view of the above, therefore, it is apparent that the crime is
already registered basing on the petitioner's complaint and it is under investigation. Hence, no further orders are required to be passed except directing the 4th respondent to complete the investigation and take appropriate steps in accordance with law. Accordingly, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
