This writ petition is filed assailing the order dated 30-062018 passed in CC No.107 of 2017 by the 1st Class Special Magistrate, Erramanzil, Hyderabad, in issuing NBW though no sentence has been recorded/imposed against the petitioner in the said proceedings, as being illegal and arbitrary and for issuance of consequential orders.

Heard the learned counsel for the petitioner and the learned Asst. Government Pleader for Home.

Having regard to the facts and circumstances of the case, it is open for the petitioner to approach the concerned Court and file a petition for recalling the NBW and on such an application being filed by the petitioner, the trial Court concerned to consider the same and pass appropriate orders thereon for recalling NBW, in accordance with law. The writ petition is disposed of accordingly. As a sequel to the disposal of the writ petition, miscellaneous petitions if any pending shall also stand closed.
