This writ petition is filed challenging the action of the 3rd respondent in calling the petitioner to the police station and threatening him to vacate Sri Sai Prasanthi Educational Society. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home produced written instructions stating that there are disputes between petitioner and third parties in respect of management of Sri Sai Prasanthi Educational Society; that a case in Crime No.9/2015 dated 26.02.2015 was registered against the petitioner under Sections 420, 408 r/w.34 IPC, on the file of Bukkapatnam Police Station; that after conducting investigation charge sheet was also filed in CC.No.63/2016 on the file of Judicial Magistrate of First Class, Penugonda, which has been recently transferred to Judicial Magistrate of First Class, Puttaparthi and awaiting for renumber. It is further submitted that the petitioner lodged a written complaint on 23.07.2018 which was registered as Crime No.45/2018 against one B.Ashok Kumar and investigation is in progress. The other allegations made by the petitioner with regard to interference of the respondent police in civil disputes were all denied. Recording the aforesaid submission of learned Assistant Government Pleader, the writ petition is disposed of directing the
3rd respondent not to interfere with the civil disputes pending between the petitioner and third parties. However, this order will not preclude the respondent police from investigating the offences. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
