THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION NO.34777 OF 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.
The petitioner complains of disconnection of his power supply given with regard to his agricultural lands in Survey Nos.447 and 449/A of Rajapur Village, Balanagar Mandal, Mahabubnagar District. The petitioner states that he has raised horticulture garden in the entire land of Acs.9.04 gts and there are standing fruit bearing trees of all kinds. However, even though the petitioner has been paying all the consumption charges of his power connection bearing S.No.M013 00238, the power is stated to have been disconnected without notice to him and contrary to Section 56 of the Electricity Act. Challenging the said action, the present Writ Petition is filed.
Learned Standing Counsel, on instructions, states that no doubt the petitioner has been paying the bills regularly but the other consumers who are getting power through the Transformer have defaulted and that has resulted in shut down of the Transformer. However, appropriate arrangements have to be made so that the service connection of the petitioner is restored. In view of the above representation, the Writ Petition is disposed of directing the respondents to forthwith ensure that the power supply to the petitioner's service connection is released, either through the Transformer or through other alternative mode. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
