THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4115 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 to 10 under Section 482 Cr.P.C. seeking to quash the proceedings against them in FIR No.55 of 2016 on the file of the Kodad Town Police Station, Kodad, Nalgonda District, registered for the offence punishable under Sections 420, 448, 427, 504 and 506 r/w 34 IPC. Heard and perused the material available on record. It is alleged that the 1st respondent purchased the house property in question from its owner Challa Kotamma and got it registered on 23.12.2015. After registration of the said house property, the possession was also delivered to him. While so, the petitioners Nos.1 to 4 along with other accused fabricated the documents and transferred the house property in question in favour of petitioners 5 to 8.

It is the case of the petitioners that they have lodged a complaint against the 1st respondent and the same was registered as Crime No.54 of 2016. As a counter-blast, the 1st respondent filed the present complaint.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The 2nd respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioners. In the event of necessity, the 2nd respondent-police are directed to issue notice to the petitioners for the purpose of investigation. On issuance of such notice, the petitioners are directed to appear before the investigating officer and give an undertaking as to their future appearance as and when required by the investigating agency for the purpose of investigation. Accordingly, the Criminal Petition is disposed of. Consequently,
