HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28321 OF 2019 ORDER:

Heard Sri Kowturu Pavan Kumar, learned counsel for the petitioner and Sri D.Balakishan Rao, learned Standing counsel for respondents. With the consent of learned counsel for the respective parties, this Writ Petition is being disposed of at the admission stage.

This writ petition is filed seeking the following relief :- ".........WRIT OF MANDAMUS declaring the action of the respondents in not considering the candidature of the petitioner for appointment in the unfilled vacancy in the post of Village Revenue Officer in Khammam District pursuant to the notification No.13/2018 dt.02.06.2018 issued by the 2nd respondent as illegal, arbitrary, violative of Articles 14, 16 & 21 of the Constitution of India and consequently direct the respondents to appoint the petitioner in the post of Village Revenue Officer in Khammam District as per his merit and pass such other or further orders.............."

It has been contended by the petitioner that he is fully eligible and qualified to be appointed as Village Revenue Officer and accordingly he responded to the notification No.13/2018 dated 02.06.2018 issued by the respondents to fill up the post of Village Revenue Officer. The petitioner further contends that after undergoing regular selection process, he secured 7th rank in the merit list. While so, since the candidate who is placed at serial No.7 in the merit list has not joined the said post, he submitted a representation to the respondents on 02.07.2019 to consider his case in the said non-joining vacancy. But so far, the respondents have not passed any orders on the said representation nor

considered his case for appointment to the post of Village Revenue Officer by duly disposing of the representation submitted by him. Learned Standing counsel appearing for the respondents had contended that since the petitioner's representation is pending with the 2nd respondent, the 2nd respondent would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the 2nd respondent to consider the representation submitted by the petitioner on 02.07.2019 and pass appropriate orders in accordance with law, within eight (08) weeks from the date of receipt of a copy of this order.

With the above direction, this writ petition is disposed of. No costs.
