HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL M.P. No.701 OF 2017 IN/AND CRIMINAL PETITION No.740 OF 2017 COMMON ORDER:

Heard learned counsel for the accused. Both the petitioner and 2nd respondent/defacto complainant are present. Father of the 2nd respondent Sri R.Rajalingam is also present. Learned counsel for the petitioner and 2nd respondent are present besides the learned Additional Public Prosecutor. The offences alleged against the petitioner are punishable under Sections 448, 354 (B), 506, 509 of Indian Penal Code. Therefore, C.C.No.1319 of 2015 is pending against the petitioner on the file of X Additional Chief Metropolitan Magistrate, City Criminal Courts, Secunderabad.

Learned counsel for the petitioner would urge to record the compromise and quash the proceedings as the petitioner is a student and assured that he would not resort or indulge in such activities as alleged in the complaint.

Learned counsel for the 2nd respondent would submit that the father of the 2nd respondent has to perform the marriage of 2nd respondent by going for alliance and pendency of the C.C., would come in the way and the petitioner has ceased to indulge in any activity as he hitherto resorted to which gave rise to filing of complaint, basing on which present crime was registered and the learned Magistrate has taken cognizance in the aforesaid C.C. The same is supported by the father of the 2nd respondent.

Since the marriage prospects and future of the 2nd respondent are involved, it would be desirable to accede to the request of both counsel to record the compromise and quash the proceedings.

Petitioner and 2nd respondent are identified by their respective counsel Sri T.Ajay Kumar Goud and Sri T.Venkataraju Goud. The parties as well as learned counsel signed on the joint memo. In terms of the joint memo, accepting the joint memo as truly made by the parties, the Crl.P.M.P.No.701 of 2017 is allowed mainly keeping in view, the marriage prospects of the 2nd respondent.

Consequently, Crl.P.No.740 of 2017 is allowed quashing the proceedings in C.C.No.1319 of 2015 on the file of X Additional Chief Metropolitan Magistrate, City Criminal Courts, Secunderabad. The terms of joint memo entered between the parties shall form part of the record.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
