THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.7277 of 2015 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner / A.2 in C.C.No.1071 of 2014 on the file of the Court of the IX Metropolitan Magistrate, Miyapur at Kukatpally.

2 At the time of arguments, the learned counsel for the petitioner sought permission of the Court to permit the petitioner to withdraw the petition with liberty to avail the remedies available to him under law. He further requested that the presence of the petitioner before the trail Court may be dispensed with on each and every date of adjournment. Permission is accorded.

3 In the result, the petition is dismissed granting the liberty as prayed for. There is no dispute with regard to the identity of the petitioner who is A.2 in the case. Even if the presence of the petitioner is dispensed with, no prejudice will be caused to the 2nd respondent. Hence, the presence of the petitioner who is A.2 in C.C.No.1071 of 2014 on the file of the Court of the IX Metropolitan Magistrate, Miyapur at Kukatpally is dispensed with on each and every date of adjournment. However, the petitioner shall appear before the trail Court as and when his presence is so required. Consequently, miscellaneous petitions, if any, pending in this petition, shall stand closed.
