THE HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.9059 of 2013 ORDER:

In this Petition filed under Section 482 Cr.P.C., the petitioner/accused seeks to quash the proceedings in Cr.No.309 of 2013 on the file of Chaitanyapuri Police Station, Cyberabad, whereunder he was charged for the offences under Sections 506, 509 and 354 (D) (1) of IPC.

When the matter came up for hearing, learned Public Prosecutor by producing a copy of the charge sheet submitted that the police have laid charge sheet on 29.07.2013, which was taken cognizance and numbered as C.C.No.1295 of 2013 by the learned XI Munsif Magistrate, L.B.Nagar and hence, the instant petition, which is filed for quashment of the proceedings, has became infructuous and prayed to dismiss the petition. There is no representation for the petitioner. It is seen that pending Criminal Petition, no stay was granted. On perusal of the copy of charge sheet dt.29.07.2013, this Criminal Petition is dismissed as infructuous and liberty is given to the petitioner to challenge the charge sheet by initiating appropriate proceedings, if so advised.

Consequently, the miscellaneous petitions, if any, pending, in this case, shall stand closed.
