OFFICE NOTE 07.04.2022 KS,J I.A.No.2 of 2022 This application is filed by the petitioner/accused No.1 seeking to relax the condition to appear before the NCB officials, Hyderabad, once in a week between 12:00 Noon to 2:00 pm passed by this Court in Crl.P.No.9454 of 2021 on 14.12.2022.
Heard both sides.
Learned counsel for the petitioner/accused No.1 would submit that the petitioner is a resident of Channai.
Pursuant to registration of another crime, as per the direction of Hon'ble High Court of Madras, the petitioner is appearing before the NCB officials at Chennai everyday.
Therefore, the condition imposed by this Court to appear before the NCB officials at Hyderabad, once in a week is causing great inconvenience to the petitioner and he is not able to travel every week from Chennai
to Hyderabad and ultimately, prayed this Court to relax the said condition.
Learned Public Prosecutor opposed the petition.
Having regard to the averments made in the accompanying affidavit and considering the fact that the petitioner/accused No.1 is appearing before the NCB officials at Chennai on everyday, the condition imposed by this Court to appear before the NCB officials at Hyderabad once in a week is hereby relaxed. However, the petitioner/accused No.1 shall appear before the NCB officials at Hyderabad, as and when required for the purpose of investigation, if any.
The petition is ordered accordingly.
