THE HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.2799 OF 2007 ORDER:

This writ petition is filed questioning the action of the 1st respondent in issuing the declaration dated 18.1.2007 under Section 6 of the Land Acquisition Act, 1894 (for short, "the Act"), proposing to acquire the extents of Acs.8.01 cents belongs to the petitioners situated in Sy.No.1/1, 4/1, 4/3, 5/1 and 5/3 of Mukthinuthalapadu Village, Ongole Mandal, Prakasam District, pursuant to the notification dated 1.9.2006.

Writ Petition came up for admission on 19.02.2007 and interim stay was granted on that day.

Today, when the matter has come up for hearing, learned Government Pleader for Land Acquisition submitted the written instructions of the Revenue Divisional Officer, Ongole dated 13.6.2013, wherein they have stated that the land of Sri Bodapati Ramachandraiah, S/o. Sreeramulu and five others for which draft notification and draft declaration were published for providing the house sites to weaker sections, is no longer required. In view of the above mentioned written instructions, no further orders are required to be passed in this matter and the writ petition is liable to be closed.

Accordingly, the writ petition is closed. No order as to costs. Consequently, the Miscellaneous Petitions pending, if any, shall also stand closed.
