THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11368 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused in FIR No.203 of 2025 of Parigi Police Station, Vikarabad District, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 13.07.2025, the de-facto complainant lodged a report before the police stating that, since one month he has been staying in Parigi along with his family members and he had one daughter and one son and his daughter is studying 10th class at Parigi. On 13.07.2025 at about 08:00 hours, his daughter went to bring milk, by bolted house doors from outside. After, that he made call to his brother to open the door, when he reached there and open the doors. Immediately, the complainant and his family members were searched for her near and there and friend's house, but clues are in vain. He stated that, her daughter features are round face, normal complex, height: 5 feets, worn jeans pant, white colour flower design top. Further,

the complainant had suspected one Damargidda villager by name Abhishek @ Banni who is moving closely to his daughter. Hence, the complainant requested to take action as per law. Initially, the offences reported were under Section 137(2) of BNS on grounds of complainant (father of victim girl). Later, they came to know that Accused took her daughter to a nearby bushy area, where he engaged in sexual intercourse with her. Basing on the statement of Victim girl, the LW-14 altered Section of law from under Section 137(2) of BNS to under Section 65 (1) of BNS and Section 4 of POCSO Act-2012. 3.

Heard Sri Kadire Ajith Reddy, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences and the petitioner was 18 years old, on the date of the said incident. It is further submitted that the alleged victim was voluntarily left her home without informing anyone.

It is further submitted that the petitioner is in jail from 16.07.2025 and the entire investigation was already completed. It is further submitted that the victim appeared before the trial Court and reported no objection for granting bail to the petitioner. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. It is further submitted that the petitioner herein committed sexual assault on the victim. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioner is in jail from 16.07.2025. Further, as seen from the record, the LWs 1 to 15 were examined by the investigating authority. Considering the facts and circumstances of

the case, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner/accused shall execute a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned I Additional District and Sessions Judge-cum-Special Sessions Judge for Fast Tracking the cases relating to atrocities against Women, Vikarabad District.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of

investigation, and thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
