THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4656 OF 2016 ORDER:
This petition is filed by the petitioner-Accused No.2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.625 of 2015 on the file of the II Additional First Class Magistrate, Bhimavaram.
Heard and perused the material available on record. The petitioner along with another is alleged to have committed the offence punishable under Sections 420, 506 and 406 r/w 34 IPC. It is alleged that A1, who was introduced by the petitioner, promised that he would provide a job to the brother of the 2nd respondent. The 2nd respondent paid an amount of Rs.10 lakhs to A1, as he demanded for providing a job to the brother of the 2nd respondent. But they did not do so. When the 2nd respondent demanded A1 for return of the amount, A1 abused him.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.
At this stage, the learned Counsel for the petitioner has prayed for dispensing with the presence of the petitioner before the trial Court, and for granting liberty to the petitioner to file discharge application. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the date of framing of charges, if any; on the date of examination under Section 313 Cr.P.C. and on the date of judgment.
The petitioner is directed to be represented through a Counsel before the trial Court on all hearing
dates. The petitioner is at liberty to file discharge application before the trial Court. On such application being filed, the trial Court is directed to pass orders in accordance with law. Accordingly, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions pending, if any, shall stand closed.
