wa_1440_2017 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Appeal is filed against common order dated 29-01-2016 in W.P.No. 22292 of 2015, whereby a learned single judge has allowed the said Writ Petition along with a batch of cases holding that even if a disability suffered by an employee does not fall under Section 2 (i) of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (for short, 'the Act'), he is still entitled to the benefits under Section 47 of the said Act. 2.

Sri A.Ravi Babu, learned standing counsel for T.S.R.T.C., submitted and the same is admitted by leaned counsel for the respondent that the order of the learned single judge as confirmed by a Division Bench of this Court has been reversed by the Supreme Court vide Civil Appeal No. 3529 of 2017 and batch. This Court while allowing similar Writ Appeals permitted the respondents to make representations to the appellants as permitted by the Supreme Court and the appellants were directed to consider and dispose of the said representations within three months by passing a detailed speaking order and communicate the same to the respondents.

Following the said order, this Writ Appeal is also allowed and the order of the learned single judge is set aside. The same direction as referred to above is granted in this case as well.

As a sequel to disposal of the Writ Appeal, W.A.M.P.No. 1128 of 2016 shall stand closed as infructuous.
