THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25560 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus questioning the inaction on the part of the fourth respondent for releasing the essential commodities to the petitioner's Fair Price Shop No.2 of Veerapalli Village, Badvel Mandal, Y.S.R. Kadapa District.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (A.P.).

3. A perusal of the record reveals that on 22.05.2014 the Civil Supplies Officials inspected the shop of the petitioner and found some variation. The third respondent issued a show-cause notice for which the petitioner submitted his explanation. After hearing both sides, the third respondent passed the order on 12.07.2016 and the authorization of the petitioner was reinstated. The grievance of the petitioner is that the fourth respondent has not supplied the essential commodities to his shop in spite of the orders of the third respondent dated 12.07.2016.

4. The learned Assistant Government Pleader, on instructions, submitted that the fourth respondent has made alternative arrangement to avoid inconvenience to the card holders.

5. It is not the case of the respondents that they preferred any appeal challenging the orders of the third respondent dated 12.07.2016. Once the authorization is restored, the fourth respondent has to supply the essential commodities to the petitioner's shop.

6. Having regard to the facts and circumstances of the case, the fourth respondent is hereby directed to accept the Demand Draft from the petitioner and supply essential commodities to Fair Price Shop

No.2 of Veerapalli Village, Badvel Mandal, Y.S.R. Kadapa District.

7. With the above direction, the Writ Petition is disposed of. No costs.

8. Consequently, Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
