THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10282 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of his arrest in connection with Crime.No.1223 of 2023 on the file of Meerpet Police Station, Rachakonda, registered for the offences under Sections 504 and 306 r/w. 511 of IPC.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

According to the deceased, it is informed to the Police when he was taken to the hospital with burning injuries that he set himself on fire on account of the disturbance of this petitioner along with others in respect of loan taken from this petitioner. An amount of Rs.35,000/- was taken by pledging his pulsar bike. Thereafter, an amount of Rs.12,000/- was returned for which Scooty bike was given . For the remaining Rs.25,000/-, petitioner used to continuously ask the deceased, for which reason the deceased poured kerosene on himself and set fire. 4.

Learned Additional Public Prosecutor opposed the grant of bail and further submits that the deceased died on 28.08.2023.

Keeping in view that the differences between the complainant and the petitioner are on account of loan taken by the complainant from this petitioner. It appears that on account of the petitioner continuously asking the complainant for return of money by going to his house, the complainant had committed suicide.

In the said circumstances, this Court deems it appropriate to grant the relief of anticipatory bail to the petitioner, subject to following conditions:-

1) The petitioner/Accused is directed to surrender before the Station House Officer, Meerpet Police Station, Saidabad, on or before 27.10.2023.

On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused shall appear before the concerned Station House Officer at 10.00 A.M everyday for a period of two weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
