HON'BLE SRI JUSTI CE GUDI SEVA SHYAM PRASAD M.A. C.M.A. No.1167 of 2010 JUDGMENT :

Heard the learned standing counsel for the appellant-APSRTC Sri B.Mayur Reddy and the learned counsel for respondents-claimants Sri Vasudeva Reddy.

(2) Learned counsel for the appellant Sri B.Mayur Reddy submits that appellant intends to withdraw the appeal. (3) Learned counsel for respondents-claimants submits that respondents' rights will be prejudiced if the appellant is permitted to withdraw the appeal, since respondents-claimants are seeking for enhancement of just compensation.

(4) It is obvious that respondents-claimants have not filed any cross-appeal or filed any appeal for enhancement of the compensation. Therefore, under these circumstances, I do not see any valid ground to reject the request of the appellant for withdrawing the appeal. Hence, the permission is accorded to the appellant to withdraw the appeal. (5) Accordingly, the M.A. C.M.A. is dismissed as withdrawn. No order as to costs.

(6) Consequently, Miscellaneous Petitions pending, if any, shall stand closed.
