THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.23921 of 2014 ORDER:

The prayer sought in the writ petition is as under:- "...to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the respondent No.3 in summoning the petitioner without there being any cause to the respondent No.3 police station daily and making him to sit hours together and beating him ruthlessly on the name of investigation is illegal, arbitrary, violative of Principles of Natural Justice and consequently direct the respondent No.3 not to interfere with the petitioner without there being any cause and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Government Pleader appearing for the respondents 1 to 3 placed on record the written instructions issued by the Inspector of Police, Task Force, West Zone, Hyderabad.

From a perusal of the said written instructions, it is revealed that the petitioner herein was involved in Crime No.313 of 2014 for the offence under Section 379 IPC of Sanathnagar Police Station, Cyberabad. The petitioner was arrested on 14.08.2014 and sent to judicial custody. It is specifically denied that the 3rd respondent has summoned the petitioner, detained him in the police station and beat the petitioner. It is also stated in the instructions that the 3rd respondent never harassed, threatened and interfered with the life and liberty of the petitioner, particularly by detaining him in the police station at any point of time.

In that view of the matter, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the writ petition is dismissed. No order as to costs.
