THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8315 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioner, who is arrayed as Accused No.7 in the event of his arrest in Crime No.773 of 2022 on the file of Station House Officer, Uppal Police Station, Rachakonda registered for the offences punishable under Sections 420, 467, 468, 471 and 506 read with Section 34 of Indian Penal Code.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The de facto complainant in the present case alleges that the documents were fabricated and transfers were done affecting his rights.

Learned counsel for the petitioner submits that Accused Nos.1 to 5 were arrested in this case. He also submits that in the remand report dated 28.08.2022 copy of which was given free of cost to the petitioner reflects that no case is made out against this petitioner.

But the certified copy of remand report obtained from the Court shows that the involvement of this petitioner was being probed into. 5.

However, since no overtacts are attributed to this petitioner in the remand report of Accused Nos.1 to 5, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.7 is granted anticipatory bail subject to the following terms and conditions:

i) The petitioner/Accused No.7 is directed to surrender before the Station House Officer, Uppal Police Station, Rachakonda within one week from today, and on such surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with two sureties to the like sum each, to its satisfaction.

ii) The petitioner/Accused No.7 shall appear before the concerned Station House Officer on every Monday and Thursday between 10.30 AM and 01.00 PM for a period of four (04) weeks or till filing of charge sheet whoever is earlier.

iii) The petitioner/Accused No.7 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any, pending shall stand closed. _____________ K.SURENDER, J Date: 22.09.2022 ns
