I.A.No. 03 of 2018 This application is filed seeking leave of this Court to compound the offences punishable under Sections 420 IPC and Sections 4 and 5 of Prizes Chits and Money Circulation Scheme ( banning) Act, 1978 and to record compromise in C.C.No.3 of 2015 on the file of Chief Judicial Magistrate, Machilipatnam, Krishna District, on the ground that during pendency of this petition, due to intervention of elders, the disputes between the parties have settled and they intend to lead peaceful life in future and it is voluntary. De facto complaint, the accused and the listed witnesses i.e., Lws.
2 to 20, who are the victims, are present in person and they are identified by their respective counsel and the learned Public Prosecutor for the State of Andhra Pradesh and they also produced the copies of Aadhar Cards in proof of their identity. On enquiry, the De facto complaint, the accused and listed witnesses i.e., Lws. 2 to 20, who are the victims in the case, stated that the accused paid Rs.4,00,000/ - in all to the victims including the De facto complainant towards full and final settlement. The parties stated that they settled the issue outside the Court due to intervention of elders and well-wishers as per the contents mentioned in the Joint Memo filed along with the petition. However, both the parties stated that the compromise is voluntary and in the interest of both parties to lead their lives happily.
Accordingly, this Application is allowed permitting the parties to compound the said offences and to record compromise. Cr l.P.No.7 6 1 4 of 2 0 1 8 In view of the Orders passed in I.A.No. 03 of 2018, this Criminal Petition is allowed and the proceedings in C.C.No.3 of 2015 on the file of Chief Judicial Magistrate, Machilipatnam, Krishna District, are hereby quashed. The Registry is directed to annex a copy of the joint memo to the present petition.
As a sequel, miscellaneous petitions, if any, pending in this case, shall stand dismissed.
