THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10357 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.4 seeking bail in the event of his arrest in connection with Crime.No.244 of 2023 on the file of Golconda Police Station, Hyderabad, registered for the offences under Section 8 (c) r/w. 20 (b) (ii) (C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the Golconda Police is that A-1 and two others were found in possession of ganja on 22.08.2023. The procedure was followed and they were remanded to judicial custody. During the course of investigation, the arrested accused alleged to have confessed that this petitioner was also involved in the case and the ganja seized was sold by this petitioner. 4.

Keeping in view the circumstances of the case and in the interest of investigation, this petitioner can be granted the relief of anticipatory bail, subject to following conditions:-

1) The petitioner/Accused No.4 is directed to surrender before the Station House Officer, Golconda Police Station, Hyderabad, on or before 27.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioner/Accused No.4 shall appear before the concerned Station House Officer at 10.00 A.M on every Monday for a period of eight weeks, for the purpose of investigation and thereafter, as and when required.

3) The petitioner/Accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

4) Failing to assist the investigation by this petitioner/Accused No.5, the Police are at liberty to seek cancellation of bail granted to these petitioners. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
