HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.28357 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " ......to issue Writ or direction preferably Writ of Mandamus declaring the inaction of the Respondent No.1 in deciding Appeal No.01/ 2019 dated 11/ 09/ 2019 as illegal, arbitrary and violative of principles of natural justice and consequently direct Respondent No.1 to dispose of the appeal without any delay and further direct the Respondents No 1 and 2 to place the petitioner at Sl.No.7 in the Final Tentative Seniority list vide Memo No. Ser.1/ 2/ 40970/ Zone-V/ 2019-2, dated 03.07.2019....." Heard Mr.Kowturu Pavan Kumar, learned counsel for the petitioner and the learned Government Pleader for Services-II.

It has been contended by the petitioner that he is working as Assistant Executive Engineer and he is fully qualified and eligible to be promoted to the next higher post of Deputy Executive Engineer. Learned counsel appearing for the petitioner submits that aggrieved by the Final Tentative Seniority List of Assistant Executive Engineers, the petitioner has preferred an appeal before the 1st respondent on 11.09.2019. But, so far, the 1st respondent has not passed any orders on the said appeal. Therefore, appropriate orders be passed in the writ petition directing the 1st respondent to consider and dispose of the appeal preferred by the petitioner on 11.09.2019 in accordance with law.

The learned Government Pleader appearing for the respondents contends that the 1st respondent would consider and

dispose of the appeal preferred by the petitioner on 11.09.2019 in accordance with law within a reasonable time frame. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the 1st respondent to consider and dispose of the appeal preferred by the petitioner on 11.09.2019, in accordance with law, within a period of two months from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
