THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11369 of 2025 ORDER:
Seeking the Court to enlarge the petitioner, who is arrayed as accused in Crime No.114 of 2025 of Chinthapally Police Station, Nalgonda District, registered for the offences punishable under Section 108 read with 3(5) of BNS, on bail, the present Criminal Petition is filed.

The brief facts of the case are that on 21.07.2025, the defacto complainant lodged a report with the police stating that her husband had committed suicide due to harassment by the petitioner and his family members. The petitioner allegedly threatened her husband, stating that if the case instituted against the deceased was decided in his favour, he would file a rape case against the deceased. Unable to bear the torture, her husband committed suicide by hanging himself from a neem tree in the field. The complainant alleged that Accused Nos. 1 to 5 were responsible for the death of her husband and requested that necessary action. Based on the said complaint, the police registered a case for the aforementioned offence.

Naraparaju Avaneesh, learned counsel appearing for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for the petitioner submitted that the there were ongoing property disputes between the petitioner and the defacto complainant's family and that the family of the de-facto complainant had previously attacked the petitioner's family, following which the petitioner had lodged a report, and a case was pending against the deceased. He further submitted that the petitioner had neither instigated nor abetted the deceased to commit suicide and that the petitioner had been arrested on 23.07.2025 and that the material part of the investigation had already been completed. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner were grave in nature and that the deceased had committed suicide solely due to the harassment caused by the petitioner and his family members and that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper with the
evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it is evident that the petitioner has been in judicial custody since 23.07.2025. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the period of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Principal Judicial First Class Magistrate at Devarakonda.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.
(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
