THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10278 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.197 of 2023 on the file of Nawabpet Police Station, Mahabubnagar. registered for the offence under Section 306 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant is that there was an altercation in between the petitioner and the family of the de-facto complainant regarding a plot belonging to de-facto complainant. It is alleged that this petitioner had given some amount for purchasing the said plot and later he troubled the de-facto complainant by not giving the remaining amount. When wife of the de-facto complainant questioned, the petitioner picked up quarrel, beat her with hands and abused her in filthy language, due to which, she committed suicide by jumping into the well situated in the fields of Yenugula Venkatram Reddy situated at their village outskirts.

Learned Additional Public Prosecutor opposed the grant of bail.

The disputes appear to be regarding purchase of a plot. Since the petitioner is in jail from 20.09.2023 and major part of the investigation is complete, the prayer for regular bail can be considered subject to following conditions:- i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Judicial First Class Magistrate at Mahbubnagar.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer, on every Monday at 10:00 a.m., for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
