HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28355 of 2019 ORDER:
Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents.
The prayer sought in the writ petition is as under: "... to issue Writ of Mandamus, order or orders, direction or directions, in seizing the stocks of 95 quintals of jerky seized by the 3rd respondent and handed over to the 2nd respondent under the report of the 3rd respondent dated 27.05.2019 as illegal, arbitrary and unconstitutional and consequently direct the 2nd respondent to release of the stocks of 95 quintals seized by the 3rd respondent and handed over to the 2nd respondent under the report of the 3rd respondent dated 27.05.2019 in favour of the petitioner."
Learned Government Pleader placed on record written instructions dated 20.12.2019 issued by the Joint Collector, Mancherial.
From a perusal of the said written instructions, it is revealed that as per the instructions of the higher officials at State level, the seized stocks available at MLS points were disposed of through open auction. In the said auction, on 17.08.2019, the 3rd respondent has disposed of the rice and broken rice seized from the petitioner along with other stocks at Rs.1,800/- per quintal and remitted the sale proceeds in challan No.0000002066 dated 15.11.2019.
After knowing the above said instructions, learned counsel for the petitioner seeks permission of this Court to
give liberty to the petitioner to file an appropriate application before the 2nd respondent.
Having heard both the counsel, particularly, in the light of the written instructions dated 20.12.2019, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be closed.
Accordingly, the writ petition is closed giving liberty to the petitioner to file an appropriate application before the 2nd respondent as per law. No order as to costs. Miscellaneous petitions, if any, shall also stand disposed of.
