ORDER
The petitioner claims to be the absolute owner and possessor of agricultural land in an extent of Ac.0-94 cents in Sy.No.174-1 of Keshapuram Village, Polam, Kothacheruvu Mandal, Anantapur District. When respondents 6 to 8 along with their men came to the said land and measured the same for the purpose of laying a road, the present writ petition is filed by the petitioner challenging the action of the respondents in interfering with his possession of the subject land without following due process of law.
Counter-affidavit is filed by the 4th respondent-Tahsildar stating that the Government has sanctioned a bridge across Chitravathi river for convenience to the public of four villages to reach Mandal Head Quarters. The construction of bridge was taken up and the work is under progress. The approach road to bridge will pass through the land of the petitioner and an extent of Ac.0.10 cents would be affected. Ac.0.05 cents of land is covered by cart track and remaining Ac.0.05 cents is required for formation of the approach road. So far no action has been taken for acquiring the land. The P.R.Engineering authorities have measured the land for preparation of
estimates. No requisition was received from the P.R. authorities to acquire the land for road purpose. It is further stated that no road will be formed in the agriculture fields of the pattadar until land acquisition proceedings are completed in accordance with law.
In view of the assurance given by the 4th respondent in the counter-affidavit and in the absence of any response from the other official respondents, this Writ Petition is disposed of directing the respondents not to interfere with the land of the petitioner without following due process of law. No costs. Miscellaneous petitions, if any, pending shall stand closed.
