HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.2753 of 2014 ORDER:

This writ petition is filed by the petitioner challenging the order of the 2nd respondent in RCF /4307/2013, dated 17.1.2014. 2.

The case of the petitioner is as follows:

The petitioner has been working as Permanent Fair Price Shop dealer of Shop No.2 of Marripudi village and Mandal, on regular basis for the last 7 years and his authorization has been renewed from time to time. While so, after inspection of the shop, the 4th respondent submitted a report to the 2nd respondent on 18.12.2013. The 2nd respondent issued a show cause notice to the petitioner framing four charges against him for committing certain malpractices. The petitioner submitted his explanation. It is the case of the petitioner that the 2nd respondent without considering his explanation, passed the interim order suspending the authorization of the petitioner pending enquiry. Challenging the same, the petitioner filed this writ petition.

Heard and perused the material available on record. 4.

The order under challenge is an interim order passed by the 2nd respondent. The 2nd respondent has to pass final orders regarding the subject matter of the enquiry. On 3.2.2014, this Court while ordering notice before admission, suspended the order under challenge. 5.

In the above circumstances, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The 2nd respondent is directed to pass final orders as expeditiously as possible preferably within a period of six months from the date of receipt of a copy of this order. Till such time, the interim order passed by this Court on 3.2.2014 shall continue. If the petitioner is aggrieved over the final order that would be passed by the 2nd respondent, he is at liberty to seek his remedy before the appropriate forum." 6.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed. ________________ RAJA ELANGO, J Date: 17th April, 2017 Nn
