THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.18211 of 2003 ORDER:

This Writ Petition is filed by the petitioner questioning the inaction of respondents in not appointing her son as Conductor Grade-II in the Andhra Pradesh State Road Corporation (for short 'the Corporation') on compassionate grounds since her husband, who was employed therein, died on 26-11-2001.

By order dt.15-04-2003 the respondents had rejected the application of petitioner for providing employment to her son in the Corporation on the ground that there is no scheme for appointment of persons on compassionate grounds, while offering additional monetary benefit of Rs.1 Lakh in lieu of employment. The petitioner has questioned this order. 3.

The learned Standing Counsel for respondents has placed on record G.O.Ms.No.15, Transport, Roads and Buildings (TR.II) Department dt.07-02-2014 whereunder the Corporation has decided to provide a scheme for appointment on compassionate grounds in respect of children of employees who died in harness. However, in the said Scheme, it is stated that the person seeking employment as Conductor Grade-II should have completed 21 years of age but not 35 years of age. However, there is a provision for grant of age relaxation upto 45 years of age as per Recruitment Regulations for the post of Conductor Grade-II, which is not disputed by respondents. 4.

Admittedly, the son of petitioner was born on 01-05-1979. The son of petitioner is aged 35 years 10 months

Having regard to this fact that there is a new scheme of appointment on compassionate grounds for the employees of the Corporation, who had died in harness, the respondents are directed to consider the son of petitioner for appointment on compassionate grounds as Conductor Grade-II in the said category and also consider grant of upper age relaxation upto 45 years of age as permitted by the Recruitment Regulations for the said post, subject to fulfilling all other requirements as prescribed by the respondents for the said post. This exercise shall be completed by respondents within four weeks from the date of receipt of a copy of this order.

This Writ Petition is disposed of with the above directions. No costs.

As a sequel, miscellaneous petitions pending, if any, shall stand disposed of.
