HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.634 of 2014 ORDER:

This petition is filed to withdraw H.M.O.P.No.37 of 2014 from the file of Senior Civil Judge, Sattenapalli, Guntur District and transfer the same to Senior Civil Judge, Eluru, West Godavari District for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition. According to her affidavit, respondent/husband filed O.P.No.37 of 2014 before Senior Civil Judge, Sattenapalli, for restitution of conjugal rights and petitioner/wife filed DVC No.13 of 2014, which is pending before Judicial First Class Magistrate for Excise, Eluru, which is subsequently transferred to Special Mobile Court, Eluru and re-numbered as DVC No.35 of 2014. She also stated that she gave a complaint to Women P.S., Eluru, West Godavari and the same is registered as Crime No.51 of 2014. She further stated that she admitted her children at Hanuman Junction, which is nearer to her residence and it is difficult for her to attend Sattenapalli Court from her place of residence. She also contended that she has no financial support to meet travel expenses, and for these reasons, she prayed for transfer of O.P.No.37 of 2014 from Sattenapalli Court to Eluru Court.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard argument of advocate for petitioner. 5 . I have perused the material papers including affidavit of petitioner filed along with transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of wife, I feel that the request of petitioner/wife can be considered by transferring H.M.O.P.No.37 of 2014 from Senior Civil Judge, Sattenapalli to Principal Senior Civil Judge, Eluru, West Godavari District for disposal in accordance with law.

8. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a

sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
